GRUPO FERRER INTERNACIONAL S.A. may use the Website to offer services that may be subject to special conditions, which Users shall be informed of in each specific case. The access to and browsing of the Website implies the unreserved acceptance of Terms and Conditions of Use.

3. Access to the Website

This Website is intended solely for Users over the age of 18. Generally speaking, Users are not required to register in order to access and use the Website. However, registration is required for using certain services or contents.

Users’ data obtained by signing up or logging in are protected by passwords chosen by them. Users agree to keep their passwords secret and to protect them from unauthorised third-party use. 8. Applicable law and jurisdiction

In the event that any disputes or differences arise in the interpretation or application of these Terms and Conditions of Use, the Courts and Tribunals that, if applicable, would deal with the matter shall be those provided for by law on competent jurisdiction, which, in the case of end users, falls to the place in which an obligation must be fulfilled, or the end user’s place of residence.

The foregoing is notwithstanding the right of the Users to appeal to their local Consumer Arbitration Board.

In the event that the plaintiff were a company, both parties submit to the Courts and Tribunals of Barcelona (Spain), with express waiver of any other jurisdiction to which they may have recourse.

1. Personal data protection

These forms contain specific information about the purposes for which your personal data may be processed, in compliance with the requirements set out in Spain’s General Regulations on Data Protection (RGPD) and any other laws in force on personal data protection. Your personal data shall be processed by GRUPO FERRER INTERNACIONAL S.A. in the strictest confidence and for the sole purposes to which you have consented.

Your data shall be kept on record for the maximum term allowed by law in the case of pharmacovigilance and, in the case of all other data processed, for the minimum term required by law, which shall be specifically stated on each contact form, unless you consent to a longer retention period, notwithstanding their being subject to a retention period under due protection for disclosure to the authorities.

All personal data processed is based on you having given your consent to do so. You are reminded that you may withdraw your consent at any time.

3. Exercise of rights and complaints before the Spanish Data Protection Agency (AEPD)

You may exercise your rights of access, rectification, erasure, restriction of processing, portability of data, as well as to submit any queries or suggestions in respect of the processing of personal data by writing to the Data Protection Officer using any of the following means, along with a copy of your ID document or other means of identification:

4. The non-disclosure and security of data processed

The information received by Ferrer through this Website shall be processed in the strictest confidence.

Data protection for healthcare professionals

FERRER INTERNACIONAL, S.A., hereinafter “FERRER”, shall process the personal data of healthcare professionals, either obtained directly from them of received from IQVIA Information, S.A., in accordance with the terms and conditions described in this document.

1. Data categories held by us and their legitimate use

Data provided by IQVIA Information, S.A.:

Identification details: forename and surname(s).

Work experience and academic details: specialisation, sub-specialisations, health centre.

We hold your data pursuant to the agreement we have entered into with IQVIA Information, S.A.

Other data provided directly to Ferrer: in the event you have submitted it to us

Contact details: work and/or personal email, work and/or personal telephone number.

Data inferred from medical visits: we obtain data from the contacts you have with healthcare professionals, such as medical visits, the delivery of drugs and medical devices, fees and sponsorships for attending scientific events.

2. Purposes for which we process the personal data of healthcare professionals

The data of healthcare professional shall be processed for the following purposes:

  • Managing our relationship with healthcare professionals. We use the data of healthcare professionals for managing medical visits with the intention of providing information and training about our products and services, in accordance with the consent given by you.
  • Sending messages. Should we have obtained your consent to do so, we shall use your data as a healthcare professional to send you administrative messages related to services provided, attendance at conferences and the sending of documents related to transfers of value.
  • Inviting you to events run/sponsored by Ferrer. Whenever we have obtained your consent as a healthcare professional to do so, we may invite you to events run or sponsored by Ferrer. In such cases, pursuant to the standards on transparency to which we are subject as members of Farmaindustria, you shall be asked for additional information in order to comply with our obligations in the clauses related to data protection.

3. Recipient of the personal data

Your data shall not be disclosed to third parties, unless officially required to do so by an administrative or judicial authority, or should it be necessary to disclose them to comply with a legal obligation or to satisfy a legitimate interest. Should it be necessary to do so for our relationship with you, suppliers who render us services may have access to your data, such as travel agents and companies that run the events that you attend. FERRER may request a full list of the categories of data controllers using the means set out below.

4. Storage periods

Your data may be kept on record until you withdraw your consent.

5. Location of data processing

Your data shall be processed in the European Union. However, there is the possibility that they may be transferred to third countries for the provision of services by a supplier. In such cases, it is guaranteed that an adequacy decision of the European Commission shall be in place or a standard framework agreement, such as Privacy Shield.

6. Exercise of rights

You may exercise your rights of access to and rectification or erasure of personal data, the right of restriction and/or the portability of data, by writing to FERRER’s Data Protection Officer (DPO) using any of the following means, accompanied by a copy of a valid ID document:

Should you not agree to your personal data being processed, you are entitled to file a claim with the Spanish Data Protection Agency (AEPD).
